“一个别样的审判秀”

历经5天后,薄熙来案本周一庭审结束,法院宣布将择期宣判。德语媒体指出,纵观庭审情况,只能说,薄熙来案是一次审判秀。

(德国之声中文网)薄熙来贪污、受贿、滥用职权犯罪案周一(8月26日)在诉、辩双方作最后陈述后结束。主审的济南人民中级法院宣布,将择期做出判决。此次庭审,不论是实际期限、庭审情况、诉、辩双方的表现、还是法院方面以微博方式提供庭审文字记录,都出现一些出乎人们预料的情况。尤其是被告本人全力“翻供(官方的说法)”,一一驳回起诉各要点,迫使一般认为原计划两天的庭审期一延再延。官方媒体赞此次庭审显示出中国司法作出透明化努力,德语媒体则认为,不论怎么看,薄熙来审判案都未脱“作秀”性质。 周一一期的《法兰克福汇报》这样写道:

“在官方媒体称这次以中国的标准衡量而言相当长的庭审证明中国是法治的同时,在北京的持批评态度的观察家则问道,是不是司法当局失去了对审判案的控制?”

当天的《日报》指出:

“上周四庭审程序启动之日,中国官方媒体还曾确信,两个庭审日后便会做出判决。一般情况下,90%的案子在庭审之初便已确定了量刑。然而,在前政要薄熙来案上,国家控制的媒体搞错了。在对这个拥有3000万人口的重庆市大权在握的前市委书记‘贪污、受贿、滥用职权犯罪案’的庭审中,他令人惊讶地为自己力辩。根据东部城市济南人民法院每隔一段时间公布的庭审记录文字,这位64岁的被告一再得以成功地让证人们显得不可信。法官们也进退失据,显示出,似乎对庭审进程曾有全然不同的设想。”

重庆到处都有

《南德意志报》这样评论道:

“中国的宣传机器没有一天不在欢呼薄熙来审判案的‘公开和透明’。虽然没有人可以(自由)旁听,但国家通讯社新华社却赞之为‘历史的进步’。其实,30多年前的四人帮审判案尚曾作电视直播;而今天,记者和公众们对之只能望洋兴叹。

“的确,谁事先要是认为,审判秀不会有紧张的一刻,这位被告可说是给他上了一课。然而,尽管如此,薄熙来审判秀把一个政治上颇具爆炸性的案子变成了一个家庭肥皂剧,其中有宠坏的儿子和把人毒死的母亲。是党需要这样。为洗刷自己,薄熙来在庭审中的表现可能是有点过头,但他并未对程序本身提出质疑。他自然不会提出质疑:整个司法体系仍在继续保护他,这个体系在诉状中对薄的根本意义上的罪行—残酷迫害对手、在重庆下令设置非法监狱、酷刑,以及日复一日的滥用权力—只字未提。

“审判案全然无视薄的受害人,这符合制度的逻辑。若说薄利用了警察和法院,以实现本人的意志、打击自己的对手,那他只不过是做了党的其他领导人在别的地方也做的事情。重庆到处都有。”
