调查记者刘虎因诽谤罪被逮捕

中国当局打击网络谣言的运动愈演愈烈。最近因"涉嫌寻衅滋事"被拘押的知名媒体人、调查记者刘虎现因"诽谤罪"被逮捕。其律师指出,刘虎涉嫌的所谓"犯罪事实"均是在网上举报官员涉嫌违法违纪行为或转发对官员的举报信。

微博如今成为中国当局整肃的重点

(德国之声中文网)据广州《新快报》调查记者刘虎的律师周泽证实,刘虎已于9月30日被检方批准逮捕,罪名是诽谤罪。此前,刘虎于8月23日在重庆被抓并被送至北京。北京市公安局官方微博8月25日凌晨发布消息称,刘虎因涉嫌制造传播谣言被北京警方刑事拘留。

律师周泽表示,对刘虎的指控是"因言治罪",可能是当局对其举报多名高官采取的打击报复。7月29日,刘虎通过微博举报国家工商总局副局长马正其在重庆任区党委书记期间涉嫌渎职。之前,他还在网络上实名举报上海高院代院长崔亚东有滥用职权的违法犯罪嫌疑,并将一名当事人举报陕西省公安厅厅长杜航伟的举报信通过自己的微博公开,要求国家机关调查核实。此外,刘虎还通过微博转发过其他记者的举报信,并发表或转载过诸多揭露干部违法违纪的微博。

Xue - known as Xue Manzi to his 12 million followers on Sina Weibo told Beijing police that he had made mistakes with his online postings, and held himself out as an example of the need to regulate the internet, according to a Xinhua report. The report featured prominently on major news portals on the mainland on Sunday. Xue told police in a Beijing detention centre that online influence had fuelled his ego, adding that he had misled internet users on various incidents.

从8月以来,中国当局展开了一场"打击网络谣言"的行动。一批知名的网络活跃人士-所谓的大V纷纷遭到整肃或受到压力。由于担心政权受到威胁或者社会不稳,中共再次收紧了对社交媒体的控制,限制公众讨论敏感的政治问题。

9月9日,中国"两高"出台司法解释规定,"同一诽谤信息实际被点击、浏览次数达到五千次以上,或者被转发次数达到五百次以上的",应认定为"情节严重"的诽谤行为,可判处三年以下有期徒刑。

中国网民可以利用的网络自由空间越来越有限

据媒体报道,刘虎的律师周泽表示,他认为中国政府对人民利用互联网作为反腐工具感到不快。周泽还指出,刘虎的行为属于行使公民的批评、建议、控告、检举等监督权利的行为。宪法对公民行使监督权的行为,不要求公民掌握百分之百的证据。

人权组织人权观察的调查员玛雅·王(Maya Wang)表示:"在政府出台打击网络谣言新法规后数周,一位知名的博主因诽谤官员被捕,这样的信息再清楚不过了。他们想让本来就忧心忡忡的中国网民更加鸦雀无声。"
