Kesi ya Ruto yaanza ICC

Makamu wa rais wa Kenya William Ruto amefikishwa katika mahakama ya kimataifa ya uhalifu leo(10.09.2013) kwa madai ya uhalifu dhidi ya ubinadamu, akiwa afisa wa ngazi ya juu kabisa kufikishwa katika mahakama hiyo.

Aungwa mkono na wabunge

Kundi la wabunge wa Kenya pamoja na watu wengine wanaomuunga mkono walimkaribisha Ruto na Sang, mwenye umri wa miaka 38, wakati wakiwasili kwa ajili ya kesi hiyo yenye hamasa nyingi za kisiasa.

Mlinzi wa Ruto aliwasukuma waandishi habari watoe nafasi Ruto apite , wakati Sang akisema kuwa hana hatia.

"Tuko hapa na sasa Mungu atatuangalia," Sang amesema.

"Sijafanya lolote kuhusiana na ghasia nchini Kenya, isipokuwa amani."

Rais wa Kenya Uhuru Kenyatta , ambaye wakati fulani alikuwa hasimu mkubwa wa Ruto na baadaye wakawa washirika, atafikishwa katika mahakama ya ICC Nobemba 12 mwaka huu. Yeye pia amsema hana hatia.

Mahakama ya ICC imekuwa ikipata mbinyo mkubwa duniani , hususan kutoka mataifa 54 wanachama wa Umoja wa Afrika , ambao wanaishutumu mahakama hiyo kwa kulilenga bara hilo kwa misingi ya kikabila na kuitaka mahakama hiyo kufuta kesi hiyo dhidi ya viongozi wa Kenya.

Kesi hiyo pia inakuja siku chache tu baada ya wabunge nchini Kenya kuwa wa kwanza duniani kuidhinisha hatua kuelekea kujitoa kuitambua mahakama hiyo.

Kenya kujitoa ICC

Hatua yoyote ya Kenya kujitoa kutoka katika mkataba wa Rome uliounda mahakama hiyo utakuwa na athari katika kesi za sasa, lakini wadadisi wa masuala ya kisiasa wanahofu kuwa huenda hatua hiyo ikazusha hali ya mataifa kadha kutoka bara la Afrika kujitoa uanachama wa mahakama hiyo.

"Tumekuja kusema kuwa tunataka kuweka wazi kuwa watu hawa hawana hatia," Mbunge wa Kenya William Cheptuno amewaambia waandishi habari mahakamani hapo.

"Hawana hatia hadi pale watakapothibitishwa kuwa wanahatia , hii ndio sheria katika Afrika, barani Ulaya, na kwingineko duniani."

Ruto na Sang kila mmoja anakabiliwa na mashtaka matatu ya mauaji , kuhamisha watu na watu kukamatwa baada ya wimbi la ghasia kuikumba Kenya mwaka 2007-8, na kusababisha watu 1,100 kuuwawa na zaidi ya watu wengine 600,000 walipoteza makaazi yao. Wote wanatarajiwa kupendekeza kuwa hawana hatia.

Ghasia za mwaka 2007-8 ziliweka wazi hali ya mvutano wa kikabila uliokuwa ukitokota. Ghasia hizo zilielekezwa kwa kiasi kikubwa kwa watu wa kabila kubwa la Wakikuyu nchini Kenya, ambao wanaonekana kuwa wanaunga mkono chama cha kiongozi wa wakati huo rais Mwai Kibaki cha Party of National Unity (PNU).

Ushahidi

Majaji walioendesha vikao vya kabla ya kesi hiyo wamesema kuwa ushahidi unaonesha kuwa Ruto alifanya mkutano kadha kupanga mauaji ya kikabila tangu Desemba mwaka 2006.

Mahakama ya ICC , mahakama ya kwanza duniani huru na ya kudumu kwa ajili ya makosa ya uhalifu wa kibita , mauaji ya kimbari na uhalifu dhidi ya ubinadamu, ilichukua udhibiti wa kesi hizo baada ya Kenya kushindwa kuunda mahakama yake binafsi katika misingi ya makubaliano yaliyofikiwa kwa upatanishi wa katibu mkuu wa Umoja wa Mataifa wa wakati huo Kofi Annan.

Licha ya kuahidi kutoa ushirikiano kwa mahakama hiyo , Kenyatta amesema mwishoni mwa juma kuwa hataruhusu viongozi wote kuwa nje ya nchi kwa wakati mmoja.

Jaji Eboe-Osuji amesema kuwa yeye pia anaona ni bora kesi hizo mbili zikafanyika , huenda kwa kila kesi kufanyika kwa wiki nne.
